These Terms of Service ("Terms") govern your access to and use of the Goodfit platform, including the website located at https://www.goodfit.so and any related mobile or web applications and services (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.
Goodfit is an online talent-matching platform operated by Goodfit Software LLC. Our goal is to connect jobseekers with employers by providing tools for profile creation, role posting, candidate discovery, and communication.
You must be at least 18 years old to open an account or otherwise use the Services. You must have the authority to enter into a binding contract on behalf of yourself or any entity you represent. You must use the Services only in compliance with applicable laws and these Terms.
To access certain features you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your credentials confidential. You are responsible for any activity that occurs under your account. You agree to notify us immediately of any unauthorised use or security breach.
You agree to use the Services only for lawful purposes. You agree not to misrepresent your identity, qualifications, or affiliations. You agree not to upload or share content that is infringing, misleading, defamatory, obscene, or otherwise prohibited by law. You agree not to reverse-engineer, decompile, or attempt to extract the source code of the Services. You agree not to interfere with or disrupt the integrity or performance of the Services.
Employers and recruiters agree that all job postings will be accurate, non-discriminatory, and compliant with applicable employment laws. Employers agree to treat candidate information obtained through the Services as confidential and to use it solely for legitimate hiring purposes. Employers are solely responsible for any employment decisions they make.
All intellectual property rights in the Services and its original content, features, and functionality are owned by or licensed to Goodfit and are protected by copyright, trademark, and other laws. By submitting content to the Services you grant Goodfit a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content as necessary to operate and improve the Services. You represent that you have the right to grant this licence.
Some features of the Services may require payment. When you purchase a paid feature, you agree to pay the applicable fees and taxes. Fees are non-refundable unless required by law. We may change our pricing at any time after providing reasonable notice.
You may terminate your account at any time by following the instructions in your account settings or by contacting support. We may suspend or terminate your access to the Services if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Services will cease immediately, but certain provisions of these Terms will survive, including those relating to intellectual property, disclaimers, and limitations of liability.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. Goodfit does not guarantee that the Services will be uninterrupted, error-free, or secure. Goodfit makes no warranty regarding the accuracy, completeness, or timeliness of any content or job posting.
To the maximum extent permitted by law, Goodfit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the Services.
You agree to indemnify and hold harmless Goodfit, its affiliates, directors, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses arising out of your use of the Services or your violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any disputes arising from these Terms or the Services will be resolved exclusively in the courts of that jurisdiction.
We may revise these Terms from time to time. If we make material changes we will notify users by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after any change means that you accept the revised Terms.
